Een overzicht van de juridische procedures over de crash van Vlucht MH17.

A comprehensive overview of legal proceedings relating to the downing of Flight MH17.

Op 17 juli 2014 werd vlucht een vliegtuig van Malaysia Airlines (vlucht MH17) op weg naar Kuala Lumpur boven Oost Oekraïne neergehaald met een BUK-luchtdoelraket, vermoedelijk gelanceerd vanaf een landbouwveld indoor Oekraïense separatisten gecontroleerd gebied. Alle 298 inzittenden (15 bemanningsleden en 283 passagiers, 17 nationaliteiten) kwamen om het leven. De levens van nabestaanden werden volledig ontregeld.

Het is inmiddels ruim 7 jaar na de aanslag. De strafrechtelijke vervolging van de eerste vier verdachten van betrokkenheid bij het neerhalen van vlucht MH17 is in volle gang. Daarbij bestaat voor nabestaanden het recht om schadevergoeding te eisen en inmiddels hebben 320 nabestaanden een vordering wegens immateriële schade ingediend en hebben ca 100 nabestaanden gebruik gemaakt van hun spreekrecht in de rechtbank.Daarnaast zijn onder andere een aantal juridische procedures bij het Europese Hof voor de Rechten van deMens tegen Rusland en Oekraïne aangespannen. En in al die procedures worden discussies gevoerd oververantwoordelijkheid en schuld. Nabestaanden willen dat er recht wordt gedaan en dat de verantwoordelijken voor de aanslag op vlucht MH17 ter verantwoording worden geroepen en bestraft.

De Stichting Vliegramp MH17 is opgericht in november 2014 en heeft zich -naast o.a. de organisatie van herdenkingen- statutair ten doel gesteld alle juridische procedures nauwgezet te volgen, de collectieve belangen van nabestaanden in juridische procedures te behartigen en nabestaanden zoveel als mogelijk te informeren over actuele ontwikkelingen. Daartoe onderhoudt het bestuur van de stichting intensieve contacten met de regering, de ministeries van Justitie & Veiligheid en Buitenlandse Zaken, het Openbaar Ministerie, Politie, advocatuur en de wetenschap. Elk van de lopende juridische procedures is zeer complex, doordat de internationale politiek een rol speelt, maar ook het Nederlands strafrecht, Oekraïens recht, Europees recht en internationaal recht. Het geheel van alle procedures en hun onderlinge samenhang maken het voor nabestaanden, maar ook voor professionals vrijwel ondoenlijk om nog enig inzicht en overzicht te krijgen en te houden; men ziet door de bomen het bos niet meer. Het bestuur van de Stichting Vliegramp MH17 heeft daarom in 2020 het initiatief genomen om in eerste instantie de nabestaanden, maar zeker ook andere betrokkenen en geïnteresseerden inzicht te verschaffen in alle procedures en hun onderlinge samenhang.

In opdracht van de Stichting hebben de Public International Law and Policy Group (PILPG) onder eindredactie van mr.dr. Marieke de Hoon en Patroon Legal Design de Juridische Wegwijzer MH17 ontwikkeld, waarin alle juridische procedures zijn beschreven en ook met infographics inzichtelijk gemaakt. De Wegwijzer verschijnt in digitale vorm en in boekvorm. De Wegwijzer geeft de actuele situatie van november 2021 aan. Aangezien bijna alle juridische procedures nog niet zijn afgerond, zal te zijner tijd een update volgen.

De Juridische Wegwijzer is mogelijk gemaakt door financiële en pro bono bijdragen van de rijksoverheid, het Fonds Slachtofferhulp, de Public International Law and Policy Group en de Stichting Vliegramp MH17.

Woord van de auteur

Bij de MH17 ramp kwamen 298 inzittenden om het leven. Deze 298 slachtoffers lieten een nog veel groter aantal nabestaanden, geliefden, vrienden en kennissen achter in verwarring en verdriet. Ook de Nederlandse samenleving, andere samenlevingen die slachtoffers betreurden en de internationale burgerluchtvaart waren geschokt. 

In de dagen die volgden werd de Public International Law & Policy Group (PILPG) gevraagd om de Tweede Kamer te informeren over de mogelijke juridische opties die van toepassing zouden kunnen zijn op de ramp. PILPG is een internationaal pro bono juridisch kantoor dat juridische ondersteuning verleent aan partijen in vredesonderhandelingen en in het zoeken naar gerechtigheid voor internationale misdrijven. Het Nederlandse kantoor was graag bereid om de complexe juridische aspecten van MH17 in kaart te brengen en om hierover in de jaren die volgden te blijven meedenken, onder meer in rapporten aan de Tweede Kamer. 

Toen verschillende juridische procedures gingen lopen, zoals de Nederlandse vervolging van verdachten en aanklachten tegen Rusland in Straatsburg, werd het al gauw ingewikkeld om te volgen voor niet-juristen. Daarom verzocht Stichting MH17 PILPG om een gebruiksvriendelijk overzicht van de juridische procedures te ontwikkelen. Zodat het voor eenieder mogelijk kan zijn om beter te begrijpen welke procedure zich waar afspeelt en waar die over gaat. 

In samenwerking met Patroon Legal Design, een ontwerpbureau dat is gespecialiseerd in het visualiseren van juridische complexiteit, hebben we deze website (www.mh17.legal) en een boek gemaakt.

Deze website geeft inzicht in de vijf belangrijkste juridische procedures over de MH17 ramp. Aan iedere procedure is een apart hoofdstuk gewijd. Hoofdstukken 1 tot 5 vatten de belangrijkste aspecten van elke procedure samen. De tijdlijnen, infographics en toelichting geven daarnaast meer informatie over iedere procedure. Voor sommige lezers zullen de hoofdlijnen voldoende zijn; anderen zullen meer de details in willen duiken. Hoofdstuk 6 beschrijft de overige procedures en hoofdstuk 7 gaat over genoegdoeningen en schadevergoedingen en beantwoordt specifiek de vraag van de nabestaanden over mogelijke invloed van schadevergoedingen op elkaar. 

Op het moment van schrijven zijn de meeste procedures nog niet afgerond. De hoofdstukken geven de procedures weer zodat deze beter zijn te volgen en geven ook uitleg over de argumenten die tot dan toe zijn gevoerd en beslissingen die zijn genomen. Omdat in het strafproces het pleidooi van de verdediging nog niet heeft plaatsgevonden, kon dit nog niet worden opgenomen. Voor de meest recente ontwikkelingen verwijzen we naar de website, die geregeld zal worden bijgewerkt. 

Deze website is gebaseerd op uitvoerig en jarenlang wetenschappelijk onderzoek door PILPG en de wetenschappers die daarbij zijn aangesloten. In het bijzonder gaat dank uit naar Emma Bakkum, Sindija Bēta, Paul Weber, Isabelle Jefferies, Diana Sposito, Jochem de Hoop, Daria Stanculescu, Henry Smith en Adam DiSimine voor hun bijdragen. Deze website gaat over het recht. Het recht kan echter de slachtoffers niet terugbrengen en het leed van de nabestaanden nauwelijks verlichten. Hopelijk kan het recht wel een bijdrage leveren aan het achterhalen van wat er precies is gebeurd en wie waar verantwoordelijk voor was. In complexe geopolitieke situaties, zoals de MH17 ramp, is volledige gerechtigheid, waarbij verantwoordelijken schuld erkennen, spijt betuigen en hun straf ondergaan, onwaarschijnlijk. Maar voor velen zal de openbare behandeling van bewijs en een juridische conclusie wel bij kunnen dragen aan een vorm van gerechtigheid en erkenning. Desalniettemin zijn juridische procedures vaak zwaar voor nabestaanden. Wij wensen hun daar heel veel sterkte bij en hopen dat dit boek iets bij kan dragen aan het verlichten van het leed.

About this project

On 17 July 2014, a Malaysia Airlines aircraft (Flight MH17) en route to Kuala Lumpur was downed over eastern Ukraine by a Buk anti-aircraft missile, presumably launched from an agricultural field in Ukrainian separatist-controlled territory. All 298 occupants (15 crew and 283 passengers, 17 nationalities) were killed. The lives of the next of kin were completely disrupted. 

It is now more than seven years since the attack. The criminal prosecution of the first four suspects of involvement in the downing of Flight MH17 is in full swing. Next of kin have the right to claim compensation and meanwhile 320 next of kin have filed a claim for immaterial damage and about 100 next of kin have made use of their right to speak in court.

In addition, a number of legal proceedings have been instituted at the European Court of Human Rights against Russia and Ukraine. And in all those proceedings, discussions are held about responsibility and guilt. Next of kin want justice to be done and those responsible for the attack on Flight MH17 to be called to account and punished. 

The Stichting Vliegramp MH17 was founded in November 2014 and – in addition to organising commemorations – has set itself the statutory objective of closely monitoring all legal proceedings, to represent the collective interests of next of kin in legal proceedings and to inform next of kin as much as possible about current developments. To this end, the board of the foundation maintains intensive contacts with the government, the Ministries of Justice & Security and Foreign Affairs, the Public Prosecution Service, the Police, the legal profession and science.

Each of the ongoing legal procedures is very complex, because international politics plays a role, but also Dutch criminal law, Ukrainian law, European law and international law. The totality of all procedures and their mutual coherence make it virtually impossible for next of kin, but also for professionals, to gain and maintain any insight and overview; one can no longer see the wood for the trees. In 2020, the board of the Stichting Vliegramp MH17 (MH17 air disaster foundation) therefore took the initiative to provide the next of kin, but also other involved and interested parties, with an insight into all the procedures and their mutual connections.

Commissioned by the Foundation, the Public International Law & Policy Group (PILPG), led by dr. Marieke de Hoon, and Patroon Legal Design developed the Legal Roadmap MH17. The Roadmap desribes all legal procedures and illustrates them with inforgraphs and timelines. The Roadmap will be published in digital form and in book form. The Roadmap shows the current situation as of August 2021. Since almost all legal procedures have not yet been completed, an update will follow in due course. The Roadmap has been made possible by financial and pro bono contributions from central government, the Victim Support Fund, the Public International Law and Policy Group and the Stichting Vliegramp MH17 (MH17 Air disaster foundation).

Author's preface

When Flight MH17 was shot out of the air, all 298 people on board died. These 298 victims left behind a much larger amount of next of kin, loved ones, friends and acquaintances with confusion and grief. The Dutch society and other societies that lost victims as well as international civil aviation were also shocked. 

In the days that followed, the Public International Law & Policy Group (PILPG) was asked to inform the Dutch parliament about the legal options that could be applicable. PILPG is a global pro bono law firm that provides free legal assistance to parties in peace negotiations and in seeking justice for international crimes. PILPG’s Netherlands Office provided an overview of the complex legal aspects surrounding MH17 and continued this research throughout the years that followed, among others with reports to the Dutch parliament. 

The several legal proceedings, such as the Dutch prosecution of perpetrators and the human rights complaints against Russia at the European Court of Human Rights, are difficult to follow for non-lawyers. Therefore, Stichting MH17 requested PILPG to develop a user-friendly overview on the different legal procedures. So that anyone can better understand what procedure takes place where and what it addresses specifically. 

In cooperation with Patroon Legal Design, a graphic design company that combines legal expertise with graphic explanation, we created a website and book. 

This website provides insight into the five main legal procedures concerning the MH17 disaster. Each procedure is discussed in a separate chapter. Chapters 1 to 5 summarize the main characteristics of each procedure. The timelines, infographs and explanatory text provide information about each procedure. For some readers, the outlines will be sufficient; others will want to dive into more details. Chapter 6 describes other legal proceedings and chapter 7 focuses on compensation and answers specifically to the question to what extent compensations influence one another. 

At the time of writing, most procedures have not been concluded. The chapters explain these procedures and arguments and decisions so far, so that they are easier to follow. Because the defense arguments were not yet provided in the Dutch criminal trial, they could not be included. You can check the website for most recent developments. 

This website is based on extensive academic research by PILPG and scholars associated with PILPG. This website is about law. Law cannot bring back the victims and can hardly alleviate the next of kin’s pain and suffering. Hopefully, law can contribute to finding the truth of what happened and who was responsible for what. In complex geopolitical situations such as MH17, perfect justice, in which perpetrators acknowledge their responsibility, express remorse, and are punished, is unlikely. But for many, a public consideration of the evidence and a legal conclusion in the form of a judgment can contribute to a sense of justice and recognition. Notwithstanding, legal proceedings are often arduous for next of kin. We wish them a lot of strength and hope that this book can help to some extent to alleviate the sorrow.
